§ 1

§ 1 Scope

These General Terms and Conditions apply to all contracts between Bremer Container GmbH (hereinafter "Seller") and the customer (hereinafter "Buyer") for the purchase and/or rental of containers.

§ 2

§ 2 Subject of Contract

The subject of the contract is the purchase and/or rental of containers and container-related products, including shipping containers, reefer containers, storage containers, office containers, construction containers and other special containers.

§ 3

§ 3 Offers and Prices

All offers are non-binding. Prices are stated in euros including statutory VAT. Transport and delivery costs are calculated separately and communicated transparently before the contract is concluded.

§ 4

§ 4 Conclusion of Contract

A contract is only concluded upon written order confirmation by the Seller or upon actual delivery of the goods. Non-binding enquiries do not constitute a contract.

§ 5

§ 5 Payment

Payment is due within 14 days of invoicing without deduction, unless otherwise agreed in writing. In the event of late payment, statutory default interest will be charged.

§ 6

§ 6 Delivery and Transfer of Risk

Delivery is ex Bremen depot of the Seller, unless otherwise agreed. The risk passes to the Buyer upon handover to the carrier or freight forwarder.

§ 7

§ 7 Retention of Title

The delivered goods remain the property of the Seller until full payment of all outstanding claims from the business relationship.

§ 8

§ 8 Warranty

For used containers, warranty is limited to material defects to the extent permitted by law. All used containers are inspected for wind and watertightness and structural integrity before delivery. Statutory warranty periods apply to new and One-Trip containers.

§ 9

§ 9 Liability

The Seller's liability is limited to intent and gross negligence. This does not apply to damages resulting from injury to life, body or health.

§ 10

§ 10 Applicable Law and Jurisdiction

German law applies exclusively. The place of jurisdiction for all disputes arising from this contractual relationship is Hamburg, provided the Buyer is a merchant or a legal entity under public law.
